АННОТАЦИЯ
Данная статья посвящена комплексному сравнительно-правовому анализу институциональных моделей региональных судебных механизмов защиты прав человека – и европейской, межамериканской и африканской систем. На основе сопоставления их нормативных основ и институциональной архитектуры исследуются ключевые параметры функционирования соответствующих судов, включая порядок рассмотрения индивидуальных жалоб, консультативную юрисдикцию и механизмы контроля за исполнением судебных решений. Особое внимание уделяется выявлению концептуальных различий в подходах к судебной защите прав человека, обусловленных историко-политическим развитием регионов. Анализ позволяет выявить структурные и концептуальные различия в функционировании региональных правозащитных механизмов, отражающие специфику региональных правовых традиций и различные подходы к обеспечению баланса между правами личности, общественными интересами и государственным суверенитетом.
