ABSTRACT
This study examines the issue of the statute of limitations in the context of the application of Article 8 of the RA Law “On the Confiscation of Property of Illegal Origin” (hereinafter also referred to as the Law). The applicability of this legal institution is specifically regulated within the Law; however, judicial practice reveals the existence of markedly divergent and, at times, mutually conflicting legal positions regarding the interpretation and scope of this provision. Under these circumstances, the issue becomes particularly relevant and necessitates the development of well-founded legal solutions, based on a thorough understanding of the institution of the statute of limitations, the objectives of the Law, and the correct interpretation of the special modalities of this institution as provided for therein.
Keywords: RA Law “On the Confiscation of Property of Illegal Origin”, in rem, in personam (types of claims), statute of limitations, modification of the subject of the claim by submitting a new claim in respect of newly identified property, Court of Appeal.
